אשהזהיר הדיין כשידע שהוא אדם רשע ובעל עבירות (והזהיר מהשים ענשו) להטות דינו. והוא אמרו יתעלה לא תטה משפט אביונך בריבו. ולשון מכילתא רשע וכשר עומדין בדין לפניך לא תאמר הואיל ורשע הוא אטה דינו תלמוד לומר לא תטה משפט אביונך בריבו אביון הוא במצות, כלומר אע"פ שאביון הוא במצות לא תטה דינו. (שם, שם):
