מי שהי' לו אשה חרשית מתולדתה. אם מהני הגט שנתן לה בעת היותו שכ"מ ולא הי' שפוי בדעתו לגמרי. השיב דיש לחלק בין שוטה לשנטרפה דעתו וראי' ממשנה נדה י"ג ב' וי"ל דהשכ"מ אין לו דין שוטה רק נטרפה דעתו ולא גרע מחרש וא"כ כיון שגם הי' חרשי' מהני גיטו:
