מושבע מפי אחרים ושתק ולא מיחה גם לא ענה אמן. השיב. על העבר אפי' לא שתק רק אמר שעשה או לא. לא הוי קבלה. ובלהבא יש להסתפק כה"ג וגם בשתק צ"ע דבמשנה יומא י"ח ב' משמע שהכה"ג לא היה עונה להם דבר. יוכיח ממשנה הנ"ל דל"ח אנוס בכה"ג:
