(לסי' קעז). שותפים היו שוכרים קרקע מהשר והי' נכתב ע"ש א' מהם, והתקצף עליו השר, ושכרו השני ואומר ששכרו לעצמו. אם לא אמר בפני עדים ששוכרה לעצמו ודאי זכה ר"ז במחצה ומהני בזה שבועת השני. וגם אז אם הי' יכול ר"ז להצילו זכה בו. אא"כ אמר לפניו שרוצה לשוכרו לעצמו ושתק. אלא דע"ז לא מהני שבועה:
